Improvements/Alterations application
Per
the Avery Park Covenants, Conditions
and Restrictions, it is the
responsibility of the property owner
to notify the Architectural Review
Board (ARB) prior to well
installation. Approval is not
required, but notification allows
the ARB to communicate directly with
the well installer to ensure
compliance with culvert
installation, water diversion and
appropriate silt fence installation
to preclude damage to adjacent
property or community property. If
this is not done, the property owner
is responsible for clean up of the
property and any repairs required.
Additionally
per the Architectural Design
Guidelines, if the well is
functional, the area around the well
needs to be cleaned up and a
simulated rock placed over the well
casing. If the well is
non-functional, the area around the
well site must be returned as much
as possible to the pre-existing
condition and native shrubs planted
to conceal the area. Per Buncombe
County requirements, the
non-functioning well must be filled
and permanently sealed/capped.

TREE CUTTING GUIDELINES FOR AVERY
PARK
According to the Declaration of Covenants, Conditions,
and Restrictions for Avery Park, Article 9.5 (b) (ii), the following
guidelines pertain to tree removal:
Tree Removal. No trees that are more than six(6)
inches in diameter at a point two(2) feet above the ground shall be removed
without the prior written consent of the ARB; provided however, any trees,
regardless of their diameter, that are located within ten (10) feet of a
drainage area, a sidewalk, a residence, or a driveway, or any diseased or
dead trees needing to be removed to promote the growth of other trees or for
safety reasons may be removed without the written consent of the ARB. The
ARB may adopt or impose requirements for, or condition approval of, tree
removal upon the replacement of any tree removed.
The above guidelines are reinforced in the
Architectural Design Standards under Article 3 (c):
In accordance with Article 9, Section 9.1, of the CCR’s,
no exterior structure or improvement shall be placed, erected, installed, or
made upon any Property/Unit, or adjacent to any Property/Unit, without first
obtaining written approval from the ARB. Examples include, but are not
limited to, the following:
(c) Removal of trees (greater than six inches in
diameter), evergreen shrubs or other distinctive vegetation.
Additionally, under Article 5.9 (a) Landscaping and
Fences, the following applies:
(a)
No clear-cut tree removal or topping of trees is
allowed. Very selective tree removal and/or thinning to improve views may
be considered for approval. |
